The UAE arbitration laws include contractual disputes between two companies. Disputes between the Companies shall be resolved by the Dubai International Arbitration Center. The provisions of Federal Law No. 6 of 2018 on Arbitration and the provisions of the Dubai International Arbitration Center Rules 2022 shall apply.
An arbitration agreement/arbitration clause in a contract must meet the conditions set out in the UAE Arbitration Act to be valid and enforceable.
Arbitration is not permitted in matters where a waiver is not permitted. An arbitration agreement may be terminated only by a natural person with the legal capacity to exercise its rights or by a representative specially authorized to arbitrate on behalf of a legal entity.
Unless otherwise agreed by the parties, the arbitration agreement shall not be terminated or discharged by the death of either party, but shall be enforceable by or against the deceased's legal successor.
Whenever a provision of this Act leaves the parties free to agree on the procedure to be followed in determining a particular issue, each party may authorize a third party to select or determine that procedure.
If the defendant contends that the dispute is moot at the court's first hearing, the court may decline to take action. The arbitration clause in a contract. However, the court may not refuse to proceed if it is satisfied that the arbitration agreement/clause is void or unenforceable. This is in accordance with Article 8(1) of the UAE Arbitration Law.
